States of Protest and Popular Extraterritoriality
Where is international civil society? In a forthcoming piece on metro-centricity in international legal thought, I observe that the conceptual space of international civil society tends, unreflectively, to be associated with the physical space of the city. This talk is a first attempt to theorize two locations of long-term protests or occupations: foreign embassies and foreign military bases. I suggest that a frame that pits ordinary free speech against foreign relations does not do justice to law’s spatial construction of the phenomenon through both property and sovereignty and, in turn, to the legal ideas of the states involved. Questions include which actors construct this space in law, how to think about it, who speaks to whom and in what legal register.
